TERMS OF SERVICE

1.Contract: The clients approval for work to commence shall be deemed a contractual agreement between the client and Capture Creative Ltd. Placing an order with Capture Creative indicates client's acceptance of these terms.

2.Payment terms: Small businesses critically rely on prompt payment to function well and provide their services. As such payment for services must be made as detailed below.

1. For services valued under £2500: 60% is payable before start of project then 40% on completion of project
2. For services valued over £2500: 50% is payable at start of project. 40% at an agreed milestone, then 10% on completion of project.
3. For annual contracts, payment is to be made quarterly with the first payment to be made in advance of the contract commencement date.
4. Work will commence when funds are cleared with Capture Creative.
5. Payment shall be made in UK Pounds Sterling to Capture Creative Ltd. Initial payment to commence project is payable within 7 days. Further payments are due within 10 days of presentation of invoice.
6. In the event that any amount remains unpaid 20 days after invoice date, Capture Creative reserves the right to discontinue, withhold, or suspend services to the Customer to whom such unpaid amounts relate.
7. In accordance with The Late Payment of Commercial Debts Act 1998 interest will be charged on all payments received outside of payment terms at the rate of 2% above Lloyds Bank plc base rate. All charges incurred by Capture Creative due to late payment or cheques that require representing or fees required to recover debts will be passed onto the Customer.

3.Project content: Should the client fail to provide the agreed material within the agreed time scale causing the project to slip beyond the agreed completion date Capture Creative shall reserve the right to make additional charges. Should the client fail to provide the information within one month of the agreed date then Capture Creative will consider that the client has canceled the project. In these circumstances the client will be liable for the work that has taken place and any initial payments to Capture Creative will be forfeited.
(Projects that are held up due to contractual failure on the clients part and lack of agreed content can severely restrict Capture Creative from completing work for other clients.)

4.Tenders and Quotes: Quotations are valid for 60 days from the date of the Tender or Quote. All prices quoted may be subject to change without notice after this period.

5.Cancellation: Should the client wish to cancel at any point during the development of their project they shall remain liable for the work already undertaken that has not already been paid for and will be invoiced accordingly.
